PERSONAL INJURY LAWYER
If you get involved in a road accident, work accident, or any
other type of accident which results in personal injuries and
material losses, you might need a personal injury lawyer. He is
the person who can help you get financial compensation for your
losses, the only condition is that you don’t carry the blame for
the accident.
Now, I’m sure that you al hear the term “lawyer” before. It has
also a few other synonyms which may sound a little bit less familiar
to you, like solicitor or specialist. For example, “no win no
fee solicitor” means the same thing as “no win no fee specialist”
or “personal injury lawyer". You got the idea. But what’s the other
term supposed to mean?
What is a no win no fee personal injury lawyer?
The no win no fee agreement is a relatively new type of procedure.
Basically, it has a major advantage over anything else: it lets
you pay for your lawyer’s services ONLY with the condition that
he wins the case. It’s a principle that you might have guessed
from the name itself, but actually this is not its technical term.
The “no win no fee” term is just made up in order to perfectly
suggest its advantages. The technical term is “conditional fee
agreement”, but it’s much less used than its informal counter-part.
So, I think you got the basic idea. The truth is that the no
win no fee solicitors have opened up new possibilities for people
who couldn’t have dreamt of hiring a lawyer before. It has made
the compensation claim a much more popular endeavor, and people
are not that afraid of claiming anymore.
Before no win no fee, most people simply filed their insurance
company’s compensation claim and waited for their claim adjuster
to make his offer. When the offer came, people looked at the sum
of money offered by the insurance company with frustration, thinking
they could do nothing about it. The truth is that the claim adjuster’s
first offer is hardly the best you can get for the particularities
of your case, in fact it may simply be the worst.
But people used to (and still do) take the bait, not knowing
their alternatives. In this case, a lawyer, a personal injury
lawyer more specifically. However, there is also a major downside
of no win no fee. “I knew it was too good to be true”, you might
tell yourself. However, remember that every problem has a solution.
So, what is this big disadvantage that no win no fee has? Well,
to put it simply, if you happen to lose your case, you will have
to pay your opponent’s costs. And they may rise up to be a few
thousand pounds. That doesn’t sound too encouraging. This fact
should be presented to you by your lawyer in the preliminary interview,
just to know your options.
My honest advice on this is simple: even if you are absolutely
sure that you are going to win your case and even if your lawyer
says you will, make sure that you have those few thousand pounds.
If you don’t, there’s still something you can do.
And it’s called the “after the event” insurance. Designed for
exactly these cases, this insurance policy should have you prepared
for the worst. Now there’s a very good use of insurances. Not
that all the other insurances are bad, don’t get me wrong.
Now, this pretty much sums it up when it comes to talking about
“no win no fee”. Now, of course, this isn’t everything, but it
should give you a good place to start. Make sure that you have
your solicitor explain you every aspect of your case.
He should give you an estimate of the amount of compensation
you can get, and also an estimate of your chances to win. If it
makes you feel better, he has the power to decline your case.
If he doesn’t, that surely means that you have more than a snowball’s
chance in hell. And his experience will help you get REAL compensation.
But that’s what an injury lawyer is good at, right?
