"Special" damages
Alongside the pain and suffering element of the compensation you might receive, you can also make a claim for the specific losses that you have incurred as a direct result of your car accident brain injury. Legal costs
Most personal injury cases are brought on a no win no fee basis. The general position in English law is that the losing party pays for the winner’s legal costs. So with a no win no fee agreement, if you win, your costs are met by the other party. However, if you lose, you are technically liable for the other party’s legal bill (or an amount the court assesses as fair). Some legal firms require you to take out an insurance policy so that the insurer will fund this amount in the event of an unsuccessful conclusion to your case. The premium has to be paid at the outset of the claim, and cannot be refunded if you win. If you cannot afford the cost of the premium outright, some firms insist that you take out a loan (which they will make to you for very high interest rates).
